Akfinans Bank and Kulaksiz 5 – TRNC police “ignored the requirement of the legal system”

The Police it seems have, allegedly, decided on the rightness of the claim by Akfinans Bank Limited, ignored the requirement of the legal system, a system they are employed to uphold and assisted in allowing yet another of the Human Rights of the property owner, Mrs. McCluskey, being walked all over.

In my case, the Police were not present at the break in, nor was the Muhtar of Karsiyaka, so in effect Akfinans and Akan Kursat walked over my Human Rights unassisted on this occasion. The Police also did not turn up in answer to my plea for help, and only came when Haluk Dogandor, award-winning reporter for Star Kibris, and cameraman/journalist for ADA TV, insisted and then they did not even get out of their vehicle. They took details of my complaint, through the window of their vehicle, although not an official statement, and were made aware of the criminal break in and the very criminal attempt to run my partner over with a motor vehicle.

On the advice of a Turkish Cypriot friend, we attended Girne Police Station to check if the crime had been logged on the Police computer. The break in had, the attempted vehicular attack had NOT. This was the same evening of the break in, the advice of the police officer in Girne was to attend the Lapta Police Station, the Police Station dealing with our case, the next day to ensure they did log in the second and in my opinion, more serious crime. Eventually, and with much reluctance, Lapta Police took a statement from both myself and my partner but did not take a statement from the witness until many days later and then only when Rauf Denktaş, the TRNC Founder President, insisted that they did.

When asked what we wanted the Police to do, I was dumbfounded and asked what the options were. The Officer, with a very straight face suggested that the Police warned them not to do it again. I suggested they might like to Prosecute them. They said the case would go before the court. I heard nothing more and it wasn’t until an article written by Akan Kursat appeared in Yeni Duzen in October 2010, did I learn that the Police had reported the outcome of the investigations to him, the accused. Akan Kursat claimed that it didn’t happen and he was in another location and had witnesses to prove it. I just bet he did!! You see folks, on this magic island, no wrong ever occurs and locks can change themselves. In the same article, Akan Kursat rubbished the idea that Kulaksiz 5 had submitted a case to the ECHR in Strasbourg and he got that wrong too.

Now let’s have a look at what The Universal Declaration of Human Rights adopted by the General Assembly of the United Nations on the 10th December 1948 has to say on this subject:

Article 12 – No one shall be subjected to arbitrary interference with his privacy, family, HOME or correspondence, nor to attacks upon his honour and reputation. EVERYONE has the right to the protection of the LAW against such interference or attacks.

Article 17 (1) – Everyone has the right to own property alone as well as in association with others.

Article 17 (2) – NO-ONE shall be arbitrarily DEPRIVED of his property.

I rest my case. For today anyway.
