Libel cases ……AKFINANS BANK LIMITED v Pauline Read

The history of this, in my opinion, intimidatory civil action against me goes back to the end of 2011.

I was suddenly told by my Advocate in the Kulaksiz 5 case that the court were asking for my new address for the records. Of course, since the bank had broken into and forcibly taken my K5 villa, they knew I was not living there. Being the law abiding innocent that I am, I gave my address willingly.

No sooner had I imparted this information the Libel Writs started to be delivered by the Bailiff. Conclude what you will from that?

The first Writ is dated the 22nd December 2011 and was hand delivered outside court with the demand for costs for the case K5 lost on 26th August 2011. An attempt had been made to deliver both to my home but I was in the UK at the time.

So you see this nightmare has been going on for over 4 years and yet I was the innocent party.

My defence was technical and based on how the internet works. IT expert witnesses were called to give evidence for the defence.

The police were called as witnesses for the bank and said that writings such as those in their Writs were found on Laura the Laptop, my laptop that was confiscated by the police on the 14th October 2010 in relation to an article written about the Geoff Day case. My advocate objected on technical grounds again and the police using its powers improperly.

I have to say that since Laura was taken for an entirely different case, the police had produced no search or seizure warrant at the time of taking Laura, were told upon asking if they could take Laura “no, you cannot”. I would say misuse of powers is putting it rather diplomatically.

So the police, who still have my laptop some 4 and half years after taking it in very questionable circumstances, allowed themselves to be used to give evidence against me in a Civil case, evidence they claim to come from my laptop. No collusion there then. How can we trust the police? Remember this is a totally unrelated matter and nothing to do with the Laura the laptop case.

It seems the banks were somewhat disappointed that I was not called as a witness as they appeared keen to cross examine me. My advocate deemed it unnecessary to call me. Wise decision.

The case had been heard in full at the end of last year and the Judgment given by Judge Bertan, the new Head of the Girne District court yesterday.

The Judge found in my favour and all four cases dismissed. The bank has the right of Appeal.

So I am innocent. The cost immeasurable in trauma, stress and health but in money £3000.

    Can there be anyone (apart from you-know-who) who has any respect for the police?

    I would be surprised.

    The party goes ahead on Wednesday….be at 5 Demokrasi Sokak around mid day.

    I suspect on the instruction of the bank, the police will not allow access into the road.

    However, we must test it….but obey the police please.
