Kulaksiz 5 v Akfinans Bank Limited

You will all remember the euphoria of the so called ‘victory’ in the District Court in Girne on the 4th December 2014.

Of course it was not unexpected that Akfinans Bank Limited would Appeal the decision. They also immediately
applied for a stay in execution of the judgement by Judge Usar until the outcome of the Appeal is known and were granted that stay.

They also applied for a Court Order to stop me going near my villa until the outcome of the Appeal is known. That does not exactly gel with what my Advocate is telling me, i.e. I might have to sue Mr Mustafa Guner for my villa? Why, it was as fraudulent an act as the bank mortgages, or it will be if the Appeal court find in Kulaksiz 5’s favour. But what if they do not? If we do win the Appeal, you can be sure that I will be talking to the Judges if it becomes necessary.

You will all remember that the publicity given to the Advocates acting for Kulaksiz 5 was widespread and I am sure you will remember this:

This is why I am so surprised to read that Mr Boysan Boyra who appeared in the above programme is allegedly acting for the builders in the Olive Grove case, which is an even more airtight case than the Kulaksiz 5’s. If as is alleged, the owners have proof that not only did Koop Bank know of their existence, they were given copies of the Contracts of Sale, and if Kulaksiz 5 win the Appeal….surely the outcome of both the Olive Grove and all other victims of stealth mortgages cases is a foregone conclusion? Or am I being naive…again.
