North Cyprus Property | Kulaksiz 5 Case | 1st March 2013As has already been reported, the dates scheduled for the two hearing for the Kulaksiz 5 on the 21st and 22nd February 2013 were cancelled to give the Judge the opportunity to read through the High Court’s judgement when they found in favour of the Kulaksiz 5 by a majority verdict of 2 to 1 in favour of granting the Interim Injunction the Kulaksiz 5 had asked for on five other occasions.

As you all read in Cyprus Today, the bank’s legal adviser is quoted as saying the bank were not going to sell the remaining villas anyway.   Two of the villas have already been taken in actions that were allegedly unethical  and possibly illegal. I cannot comment on the legality of these actions, that’s the job of the court.

Since in any case, the decision only comes at the end of a hearing when both sides have had their cases heard, had their witnesses give evidence and then cross examined, one wonders why the two cancelled dates above were not utilised. This is just a personal observation and not in any way a criticism.

I would like to say that on 1st March 2013 at 10.30 am the hearing proper will begin but, based on past experience, this is something no one can be certain of.  What I can say is that, with all things being equal, the Kulaksiz 5 are scheduled to appear in their case against the bank on Friday the 1st of March 2013 at 10.30 am.
