K5 v Akfinans Bank | 5 Demokrasi Sokak Belongs To Me!WITHOUT PREJUDICE

5 Demokrasi Sokak belongs to me.

I arrived in Karsiyaka on the 6th May 2006 and even then, although unaware of it, I was living in a fool’s paradise waiting for the other shoe to drop.

The shoe well and truly dropped on the 6th March 2008, the day I became aware of Akfinans Bank Limited and their mortgages for the first time. The day I thought I was saving myself £350, the fee demanded by Naomi Mehmet to register my Contract of Sale at the Tapu.

I did indeed save money, the fee charged by the Tapu was under 50 lira. Extraordinarily though the staff, after telling me of the mortgage held by Akfinans Bank on the Kocan I shared with other K5 purchasers, asked me to sign a statement in Turkish that I knew that there was a mortgage on it and was happy. HAPPY??? They made it clear that without me signing, they would not register my Contract.

You see, even then, we were treated like idiots. I did sign, but not before I made it clear I did not understand what I was signing and insisted on writing WITHOUT PREJUDICE above and below their hand written Turkish statement. To this day, I only have their word what they actually wrote was as they told me. After hearing that during the recent hearing, a member of staff at the Tapu gave evidence that all the K5 contracts had been cancelled in 2008 and that we had all been notified and knowing this to be untrue, I can be forgiven for saying, I believe nothing that comes out of the Tapu.

We are nearing the end of 2014. We the K5 have had a minor victory at the District Court that could create a memorable precedent if the Appeal Court uphold the verdict….but I am not foolish enough to take this for granted.

One thing I am determined about is that I will either have my villa returned or be compensated for it. I will not be putting any injunctions on any OTHER property since natural justice makes the current occupier/squatter in my villa there illegally and the cynical transfer of it into a third party name is compounding the crime.
