Akfinans Bank v Kulaksiz 5 - Do Not Mentioned The BankWITHOUT PREJUDICE

I came across this blog written back in February 2012 by Peter Wright.

This was at a time when the bank were issuing Libel Writs like confetti, even allegedly to the two members of the Legal Team representing the Kulaksiz 5.

The attempt to silence the press was widespread and Cyprus Today…to this day…never mention Akfinans Bank Limited by name in their reporting of the Kulaksiz 5-v-Akfinans Bank Limited. They even issued an apology to them.

The only truly brave TRNC owned newspaper, in my opinion, is Afrika Gazetesi the editor of which allegedly also received a Libel Writ from said bank.

The last number of Libel Writs issued by Akfinans Bank Limited was allegedly 18. Of course I can only confirm positively that 5 were, since they were served on me.

This is the last paragraph of the Statement from Akfinans.

“We would like to remind that according to the Banking Law 39/2001, Article 53, any unfounded reporting or news undertaken by the respective person which will damage the reputation or harm the bank is considered a criminal act, we therefore would like to reiterate our belief that the Police, the Higher Press Authority and other respective authorities will enforce the stipulated sanctions, and would like to inform the public that we have commenced legal proceedings against the respective press or people that have intentionally reported wrong news to the public as Akfinans Bank Ltd

Akfinans Bank Ltd”

How ironic that the judgment coming from the Kyrenia District Court, on the 4th December 2014, found that the mortgages, ergo the auction that followed, were fraudulent. So I ask…who is breaking the law?
