North Cyprus Law | Go Away, Come Back Another Day!

WITHOUT PREJUDICE

North Cyprus Law | Go Away, Come Back Another Day!

We are mindful that the court system here should be respected, and I have to say I treat it with respect at all times.  However, I do feel that the system I hold in high regard does not always take into account the feelings of those caught up in the system.

Today I attended the Supreme Court believing that the attendance was a formality, that the second of the two people who I had (note the word HAD) a memorandum on their Kocan would have an Advocate who was court ready having had the writ that stopped this case being heard at the same time as the first owner served properly. No, this was not the case, apparently the writ had been served but the server had gone on holiday without sending the necessary confirmation into the court. Add to this the fact that when I arrived, the case number did not appear on the notice of cases to be heard today. Nor did I see any sign of the translator. I was seen in chambers by yet another Supreme court judge and given another date of the 30th September 2013.

I am still baffled by the fact that my Breach of Contract judgement (2316/2008) was cancelled on the 5th August 2013 by the Supreme Court with 3 judges in attendance. Why then is it necessary to repeat the process? The request of the Advocate for her client today would have been the same as that of the Advocate acting for her client on the 5th August 2013, cancellation of the Breach of Contract judgement 2316/2008. How can the same judgement be cancelled twice?

If I were paranoid, I would say it was less to do with the judgement and more to do with punishing me, but of course I am not paranoid and refuse to think that way.

Never give in never give up
