Kulaksiz 5 v Akfinans Bank – date of Hearing of Main Case announced

I have now been told that the participants in the case of Kulaksiz 5 -v-Akfinans Bank Limited have been given a date for the start of the Hearing of the main case.

Until I have been properly advised by our Advocate Boysan Boyra, I am not aware of the format this Hearing will take but the date I have been given is Tuesday 25th October 2011 at Girne District Court; as yet I have not been advised of the start time.

My understanding is that we are still awaiting the date for the Appeal against the judgement made by Judge Talat Usar on the 26th August 2011 when he refused an Interim Injunction to stop the Bank selling our properties. Judge Usar also refused an emergency Interim Injunction to stop the Bank selling our properties whilst waiting for the date of the Appeal. It is my understanding that this Appeal will take place in the High Court in Lefkosa.

During the course of this week there will also be Hearings at Girne District court in relation to the Writs issued by Akfinans Bank Limited in their effort to evict the residents on the Kulaksiz 5 site. This process usually takes some time, but as we all know, where Akfinans Bank is concerned corners seem to be cut. Eviction Order are not usually given lightly or quickly, let us pray on this occasion they will not be given at all.
