My Year – Part 4

September 2010

This month saw me attending court a couple of times in relation to enforcing the court memorandums with regard to obtaining the Court award won on the 6th November 2009 against Kulaksiz Construction Limited. Despite the best efforts of Kulaksiz Construction Limited to gatecrash one hearing some eleven months after the Judgement was given, the current state of play is that we have received permission to sell the assets covered by the Memorandum and are awaiting a date for this to happen. So 13 months plus after winning the award – I’m still waiting. I can hear you all saying ‘no change there then’.

I will just give a brief mention to Kulaksiz 5, who as you all have seen reported have attempted to obtain Justice here, and indeed are still attempting this mammoth task and in desperation have submitted their case to the ECHR, I am part of this case but would have to withdraw if I do eventually receive the court award. You all saw the reports of the formation of the 5 Wisemen Committee, which was disbanded almost as quickly as it was formed. Following an audience with the Turkish Ambassador there were hopes of Turkish intervention and the formation of an independent Committee, this too seems to have gone the same way as the 5 Wisemen Committee.

Who will forget the runaround I was given when I tried to organise a Vigil to coincide with the one being held in London on the 4th October. Every official I met whose aim I was told was to facilitate the Vigil expressed their sorrow at the way the victims of the Property scams here were being treated, but their sorrow was not transformed into positive action and after waiting, phoning and trying everything in my power to find out the decision, I finally found out via a friend who managed to ‘pin ‘ down the decision maker on facebook, so even the decision to deny me permission came via a third party and in a very unprofessional manner. I was particularly impressed by the Turkish Ambassador who said he had never had a more ‘uncomfortable’ meeting than the one with the Kulaksiz 5. He said he would have a cup of tea with us when our problems were solved and even phoned the Chief of Police to tell her he had no objection to my holding a Vigil outside the Turkish Embassy on the 4th October.

It was also during October I fell foul of the reporting laws here and was arrested on the 14th October, had four police personnel visit my house and seize my lap top with a promise that once they had looked at my hard drive the lap top would be returned to me. I have to say, that I still do not understand what I am supposed to have done wrong. I still l have not received the summons I was reported to have been receiving within a week of my arrest, I never saw the arrest warrant, never saw a search warrant, have no real idea of what I am accused of and worst of all, I still have not received my lap top back despite officially asking for it’s return. I am not a spy, I am not a drugs dealer, I am not a threat to National Security, so why am I being treated this way?

The most significant event of November has to be the ‘Vigil’, bravely led by Ismet Ustener, a good friend to all ex pats and a truely wonderful human being. Being a Turkish Cypriot, Ismet did not require permission and I am pretty sure that under the TRNC Constitution, neither did the expats, but as visitors here we did not intend to ‘rock the boat.’ So on the 15th November, we held our Property Justice Peaceful Silent Candlelit Vigil, despite all the odds, with the Turkish Cypriots as participants and the ex pats as observers. I was particularly impressed with Fevzi Hussein of Embargoed! who attended the Vigil as a private citizen. I was accompanied the majority of the time and was told I would be arrested if I crossed the road to join the Vigil on the roundabout.

It was also brought to my attention this month that there was a letter in the Turkish newspaper Avadis, written by someone called Erkan Uygun, accusing me of being a Propogandist, an owner of two villas with pools in the south and being prosecuted for insulting a Judge publicly. Since this name does not appear on the Electoral Register or in the telephone directory, I wonder who this could be, the fact that Kibris Gazetesi also carried an untrue article about me in August 2010 written by Akan Kursat, could there be a connection – not an accusation you understand.

Perhaps a well meaning friend? Avadis did print my rebuttal in full for which I thank them. That it is all untrue is understood but I sort of wish I did own two villas with pools in the south, simply because I could do with the money, who couldn’t?

Without a doubt the most signficant event of this month has to be Geoff and Mary Day’s double whammy. To win their Civil case and then to go on to win Geoff’s Criminal case, there are no words to describe how elated I am for them.

This month has also brought home to me just how many ex pats are now leaving the TRNC. I know of 5 couples who will be gone by the end of this February 2011. People who planned to be here for the duration. How sad is that?

I developed a cold which has turned into Bronchitis over the Christmas period; as I have made you aware I suffer from a chronic condition called Bronchiectasis so unless the sky falls in, I cannot think I will have anything new to add to this before the end of the year, simply because I am not well enough to venture far.

Can I take this opportunity to thank you all for your support, for reading my blogs and wish you all a Very Healthy, Happy and Prosperous New Year. Let’s hope 2011 is the year of the solutions to all the Property Problems here in the TRNC. I love the TRNC.
