WITHOUT PREJUDICE
This is the message I have just received from a fellow litigant in the Kulaksiz 5 -v-Akfinans Bank Limited case.
“The judge found the Mortgage Fraudulent and the auction. Both judgements to set aside. We have won this round.”
This still has to be confirmed and of course will almost certainly be challenged by the Bank by means of an Appeal to the High Court.
I am speechless.

As you can all imagine, I am in shock. This day has been a long time coming and to say the bank has put me personally through hell would be an under statement. As we know many dishonest TC’s and a few Brits have aimed a well placed kick at me too.
The important things is I, together with all the rest of the K5 victims have been given a much needed reason to hope.
Thank you Hasan Alkan, you have played a blinder and you deserve to celebrate tonight. Hasan has confirmed our victory in the District court and made a point of saying ‘you also won the case * which is very reassuring since on paper the bank have already transferred my villa to a
3rd party.
We have some talking to do and probably an Appeal by the bank at the High court to face.
This decision must give hope to all the other victims of stealth mortgages.
Thank you all for your continued support. You have given me the strength to go on.

The correct decision but one I think we all doubted was possible.
A lot of questions now need answering not least the credibility of Akfinans operating as a bank. The Central Bank should initiate immediately an inquiry into how and why Akfinans gave illegal mortgages. This can and must be done despite appeals within the legal system to protect the integrity of TRNC banking system. For example is this the only illegal mortgage they gave out and as we all know how many other banks have done the same.
I hope any appeal follows quickly and is thrown out just as quickly. I wonder what those living in Pauline & Chris house are thinking right now because they want their home returned ASAP.
A win at this battle but not yet the war!!
I am so pleased for all of Kulaksiz 5, especially Pauline Read who has championed this cause with never ending perseverance, through her partner’s health issues and animosity from others.
I just hope Akfinans Bank decide enough is enough and make the necessary amends to the Kulaksiz 5 without pursuing this case any further as the health of enough people has suffered already.
Pauline will keep you all updated of whatever the future brings for K5.

I am shocked with the decision but so pleased for you all.Without doubt the constant fight to keep this in the public domain and highlight the wrong doings at every opportunity has paid of. Let us hope that this can now be dealt with in a manner that meets the wishes of the K5 and that there is no longer the need to drag the TRNC through the EU courts and further damage its reputation and property market.

Doubt if the bank will take no further action. and there will be lots more court appearances, but this initial victory is hopefully a turning-point.

What I find amazing is that forum where Pauline has constantly been vilified has yet to even mention this court decision. A decision that could have mega consequences for many other people.

Oh no, just when you think it is safe to go back in the water, more scum rises to the top.
This involves, Libel cases, Laura the laptop and more violations of Pauline’s privacy and human rights.
They ain’t going away quietly so neither can Pauline.
