K5 v Akfinans Bank | Love Your Neighbours

K5 v Akfinans Bank | Love Your NeighboursWITHOUT PREJUDICE

Last night it was made clear that my neighbours and fellow owners of property at Kulaksiz 5 do not like or approve of my asserting my right to have my villa returned to me.

As I have been deprived the pleasure of being able to occupy it for almost 5 years, and they in the main have been able live in theirs, I find this attitude very odd and not a little self serving.

The other owner deprived of her villa is Eva McCluskey, who has never occupied her villa on a full time basis.

From 6th May 2006 to May 2010, I did live in my villa full time. Yes I did move out, yes at that time it was unsafe to live in due to the damp spores that pervaded the whole of the villa. I did lock and secure it. I did visit it at least twice a week to ensure it was safe and secure.

What happened on the 30th July 2010 denied me the right of deciding what to do about it. The bank illegally, according to my then advocate and common sense, broke in and took my villa

“Dear Pauline Read

I have spoken to Sila about this.

She believes that, as you were in possession of the property and the bank have wrongfully changed the locks, that you are entitled to re-enter and re-take possession. However, she advises, as a precaution, that you to contact the police officer in charge of the case to inform him that you intend to do this and to seek his assurance that it is ok for you to do so.

Dear Pauline Read

The bank had no legal right to break into your property. They cannot evict you without an order to do so and they have committed a criminal offence. You must follow this up with the police to ensure that a proper investigation is carried out.

I have seen today’s front page article in the Kibris newspaper. Hopefully having so much publicity will help to ensure that this matter is not ‘swept under the carpet’

Subject: RE: Akfinans break in at my villa on Kulaksiz 5(DPS:NM2425)

Dear Pauline Read,

Sila and I are both shocked and appalled at this situation. I am pleased to hear that you have made a formal complaint to the police. It is important to follow this up with the police. Please keep us informed.

These mails from the time of the break in and illegal seizure of my property proves beyond doubt I should be given my villa back.

The finding in the judgement of the 4th December 2014 that the mortgages were confirmed as fraudulent from the day they were put on 11th November 2005, further confirms that the bank acted in bad faith and the only right action on their part would be to hand my villa back TODAY.

However my neighbours feel about my actions, I cannot worry. I am right, the bank is wrong. It would be nice to have their support, failing that I would ask them to mind their own business. I absolve them from any responsibility for MY actions.

Never give in never give up

    Exactly dj.

Yesterday was an information gathering day and Pauline let me loose to sleuth to my heart’s content. I was extremely successful….I now know many of the banks secrets..they sure to have plenty.

KARMA is biting them on the bum BIG TIME.

They should not be surprised. If you do bad things to innocent people, you will have bad things happen to you, they will continue till you RIGHT the evil things you have done. Feeling lonely Ertug?

Don’t you love the way Naomi thinks there would be some point in going to the police?

  • Polly Marples

    Yes….what a joke….what a joke she was too.
