So why did the Kader family take such a shine to Pauline’s villa, why did they single it out and covet it so?

It seems that in their attempt to hang on to their ill gotten gains, they decided to sell it on so that a name other than Kader (the bank family name) would appear on the Kocan. I use the word ‘sell’ loosely, informants tell us that the figure on paper is allegedly between 30,000 and 40,000 lira, less than £12,000.

What they forgot about is the existence of Polly Marples….sleuth extraordinaire and the biggest nosey parker in the world. Polly has a way with dogs….she even speaks dogese. Butch willingly barked out so many bank secrets. Butch is such a blabber mouth.

If you do decide to compound your first fraudulent act with a second, do not use a former Director of the Bank as your alleged accomplice, more importantly, do not use your father-in-law who also happens to be that former Director. Polly Marples will sleuth and sleuth until she hunts your guilty secret down (ably assisted by Butch). Sherlock Holmes had his Dr Watson, Hercules Poirot his Captain Hastings, Polly now has Butch.

So now, the bank have attempted to distance Pauline’s house from her ownership by making it twice removed from her. But…and there is always a but. Judge Talat Usar has judged that the mortgages were fraudulent from inception. He has further ordered that all the properties with new Kocan numbers be put back on to their original two Kocans i.e Kocan 7736 and 7739.


All, means all and surely to ignore such a judgment by cherry picking out one property, simply because it has been a subject of fraud twice, would be wrong. It could also be seen as contempt of the court order. The fact that the bank has taken such a ‘shine’ to Pauline’s property is not reason enough to omit it from the transfer. It was on the original Kocans in the landowner’s name, that is where the judge has ordered it to be returned. The judge did not single it out for special attention, neither should the advocates.

Now all this could be academic if the High court overturns the judgement by the lower court of the 4th December 2014.

The bank somehow managed to get a ‘stay of execution’ from the courts so that the judgement of the 4th could not be acted upon until after the Appeal.

But, and there is always a but, if the High Court upholds this judgement then the changes in the status of all the properties and should take place.

Pauline Read’s villa at 5 Demokrasi Sokak should then be on Kocan 7763 in the name of Yuksel Yilmaz, excactly as it was before the bank changed it to Kocan 8451 and then allegedly fraudulently transferred it to Mustafa Guner. Exactly as it was before the imposition of the allegedly fraudulent mortgages.

If the High Court upholds the ruling of the lower court Kocan numbers 8450, 8455, 8449, 8454, 8457, 8459, 8456, 8458, 8451 (Pauline’s) 8448, 8452, 8453, 8460, 8462 and 8461 will no longer exist. 15 Kocans, how was it ever possible for a bank to justify taking so much security as collateral for a loan of 83,000 lira? Rhetorical question.

Bank law 39/2001 was brought in to protect the banks. Why at the same time was that not a law brought in to protect us from the banks?

    I would expect that no matter what they declared the sale value to be, the Tapu office would have sent out an official to check out the true value of the villa in order for the correct taxes to be paid.

    One other point, has landowner signed the land over to Mr Guner and as such confirmed the legality of the new title deed?

    Surprise surprise, such information is not readily available.

    Pauline asked for a copy of the Kocan showing the villa in the name of Mustafa Guner. She was told by the K5 advocate that she could have it, then she was told it could not be found, then she was told he had submitted it to the court, then asked if he had not kept a copy..he said no, then she suggested he contact Akan Kursat and get another copy, then she was told he would, then she was told Kursat was not answering his phone. She is still pushing for a copy. Is Pauline getting VERY suspicious…you betcha.

    An advocate who does not keep copies of everything submitted to court?? Bit like way back in 2008 when Pauline asked Ertug Kader of Akfnans Bank for a copy of the loan agreement and he said he could not give it to her because he had lodged it with the court. This lack of copies seems to be contagious.

    To answer you question WG. who knows. Remember this is Kyrenia Tapu who tesfified ON OATH that they had cancelled the K5 Contracts in 2008 and had told the K5 this, also in 2008 and that was perjury.

    Surely if a Tapu officials testimony to the court was not believed by the judge wouldn’t he have to be investigated by the authorities and all the land registry records regarding all the K5 properties scrutinised for accuracy by a superior or independent examiner?
    I feel sure this would have happened in the UK.

    This would, of course, be the same TAPU that assisted my buyer in almost getting my house transferred to his mother’s name without payment to me.

    I know the name of the TAPU individual who did it, a very well-known name.

    I also know the names of the two individuals from the developer who took part in the attempted fraud.

    When the house eventually sold, before I could get my hands on the cheque I had to sign an undertaking that I wouldn’t take any action against the developer.

    So even my lawyer was crooked!

    Well they got it for tuppence halfpenny so they could afford to spend a lot of bank money on it turning it into a fortress/palace?
