I am told that last night there was a 2 hour TV programme on Channel T TV in north Cyprus devoted to discussing the recent Judgement in favour of the Kulaksiz 5 and its implications. Good publicity for all with ‘stealth’ mortgages or indeed memorandums on their properties.
There was a panel consisting of Boysan Boyra as the Chairman, Hasan Alkan, Attila & Malcolm Mitchison with Evren interpreting.
The guest panel was David Wilson and Phil Watkin-Jones, owners from K5, there were also representatives from Harmony and Olympus sites ( Boyut purchasers) who have stealth mortgages on their properties put on by the Near East Bank.
The programme masterminded by Boysan did a tour of the K5 site examining the unacceptable behaviour of creditors and the tragedy they caused.
The programme went out in Turkish, it finished off with clips of the K5 on-site celebrations and a rerun of the DVD “Banks Behaving Badly”.
Whilst my villa sits on the site looking like the castle belonging to the feudal lord, the rest of the properties are deteriorating rapidly, due to their being so badly built. The future at least looks a little rosier for the other owners. For me and Eva McCluskey I cannot say, although my villa is the only one transferred into the name of a third party, albeit a cosmetic transaction since the bank family weekend in my property. Now even the District Court acknowledge that the mortgages and auction that followed was fraudulent, ergo my villa was never theirs to dispose of or live in. Interestingly, they put 5 CCTV cameras around my villa, were they always unsure of their tenure?
That is good to hear. The more publicity the better, maybe it will deter other would-be fraudsters.
One thing is for sure fluter, justice is still a long way off and is still going to cost an arm and a leg, money Pauline no longer has, nor can she afford.
The bank realise this, of course, and has been waiting for you all to have to give up and go away.
If they lose on appeal, is there any likelihood that they will obey any court orders?
No all it means is that they can reapply and reopen the case they got the repossession order on, on 20th November 2008 and this time we, the K5 can join in this case which will mean another hearing and possibly another Appeal and so it goes on and on and the only winners are the advocates and the legal system coining in more fees.
The Bank also needs to consider the poor publicity it has already generated and the further negative publicity that will now follow the case to conclusion. Up till recently there has been little media reporting on their fraudulent behaviour, now reporting is widespread.The damage to their reputation will hit them financially. Who wants to do business with a Bank that cannot be trusted to act professionally, honestly and appears to know little about business law and acting within the countries legal framework? Add to this more legal fees, more evidence of corruption because I suspect more information will be forth coming with regards to who also participated in this obvious scam and you wonder if they will be sensible enough to take responsibilty and agree to some sort of amicable closure. Even if they appeal and win, won’t this just be a short lived victory until the whole affair is re-examined at the European Courts?
You cannot shame those that have no shame but you can change public opinion and hit the shameless where it hurts them the most…….their pockets.

I fear that the banks reputation will suffer little from the publicity. The owners are already so well known in North Cyprus for what they are. The only way that they will suffer is if the government in the form of the central bank start an audit process NOW, release an early interim report before a final report. If as we all suspect from the judges summing up there has been some under hand dealings the bank would then suffer punitive action.
Unless someone high up has real balls then nothing is going to happen, The Family appears to have strong links to everything and everybody!!!!

Turkish Cypriot cannot use his land in Paphos as he lives in Pyla
It is reported that the application of a 55 year old Turkish Cypriot who applied to the Greek Cypriot Supreme Court to reclaim the three properties he inherited is rejected.
According to Politis newspaper, the Turkish Cypriot who Gavel hammerwas born in Poli, Paphos, inherited three properties from his mother and transferred them to his name in 2011. He later applied to Guardianship of Turkish Cypriot Properties to get permission to use the land but his application was rejected and his case was carried to court.
According to the Greek Cypriot Supreme Court’s decision the basic argument of the Turkish Cypriot “Guardianship of Turkish Cypriot Properties has taken its decision by a legal mistake, justification of usage of property by the Guardianship, being considered as a Turkish Cypriot who owns property in South Cyprus, is not possible because he is a Pyla resident.” And therefore even though the property in Paphos is his, as he resides in Pyla, the court decided not to give him the right to use his property.

” According to official statistics more than 82 percent of property in the occupied area prior to the Turkish invasion of 1974, was either owned by Greek Cypriots (60.6 percent) or by the Republic of Cyprus itself (22.82 percent). By contrast barely 16 percent of the property was owned by Turkish Cypriots.
Following the Turkish invasion, the illegal regime in the occupied north of the island claimed ownership of the 82 percent of land and produced bogus title-deeds in an attempt to create new ownership. ”

The RoC has not issued dodgy deeds of Turkish Cypriot land and properties in the free parts of Cyprus and has not invited low down cheapskates to purchase such lands.
