Akfinans Bank v Kulaksiz 5 - The Appeal ApproachesWITHOUT PREJUDICE

It seems so long since the Judge found the mortgages put on the pensioner owned Kulaksiz 5 properties by Akfinans Bank Limited were fraudulent. Indeed it is, it was 4th December 2014 almost two years.

After much drama and shenanigans the Appeal against this decision by the bank is set to be heard at the High Court in Lefkosa on the 4th October 2016. Will it be heard, or won’t it be heard? I am told it is still scheduled for then, but who knows?

This is my report of the 4th December 2014 victory.

The bank have been living in my villa for over 6 years now and if the High Court upholds the decision of the 4th December 2014, they will have being doing so illegally. There are those who would say that with or without the decision going in our favour, the bank acted unlawfully when they broke into and took my villa on that traumatic night back in July 2010. My then advocate, Naomi Mehmet, even put that opinion in writing to me. A night me and Agile (God rest his soul) would never forget. Here is the account of what happened in July 2010 and the shameful actions of Akfinans Bank Limited.

Needless to say the police, although they had the crime reported to them, never ever reported back to me. Seems everything is for sale in north Cyprus.

This is my villa now after 6 years plus of occupancy by the bank owning family.

At least they have kept in it a good state of repair.

I do not expect to ever be able to occupy it because I know the bank will do everything in their power to stop me, regardless of the court decision and I know no-one will lift a finger to stop them, which speaks volumes about the state of justice in north Cyprus.

Their strategy to outlive all the Kulaksiz 5 owners will work and although we know it should not, we also know it will.

    It is the police attitude that really makes me mad!

    As for the Kaders, they make the James Gang look like amateurs.

    And still there are people on a forum saying what a wonderful place it is to live. One of them even came out with the old chestnut about doing your homework. They are the ones who make my blood boil.

    Jerry, had the GCs treated the TCs with some humanity maybe 1974 wouldn’t have happened.


  • Is the high court appeal going ahead today (4th October) If so, can anyone attend, where is it, and what time.
