North Cyprus Law | Pauline’s Court Cases to Date


I did write about my success in the Kyrenia District Court with my Libel cases. The court took the intelligent view to hear all the cases at the same time and so cases


were all heard at the same time but remained 4 separate cases.

I now have a copy of the judgement which was released from the court on the 27/03/2015. Since this judgement is subject to an Appeal by Akfinans Bank Limited I will not be commenting in detail on it.

Suffice to say the Judge found that it was not proved that I libeled the bank and, as you all know, I have always maintained that view. At no time have I ever by word or deed libeled Akfinans Bank Limited.

So now I am awaiting two Appeal dates, this one and the one for the Kulaksiz 5 v Akfinans Bank Limited. It will be
interesting to see which comes first as although the Libel case hearing ended at the end of 2014, the judgement was
given on the 27.03.2015. The judgement for the K5 case was given on 04.12.2014, so in theory that Appeal date should come first. Be interesting to see how it pans out.

    Wonder if there will ever be an appeal date for this one as well.

    If there are appeal cases on either of these, and you and K5 win, can the bank then appeal again?

    No…that’s it. finished no matter who wins.

    But the Libel case will be over.

    The K5 case is not. They are only winning the right to go back to the situation prior to the bank winning the right to auction K5. So the Kocans will be put back into the name of the landowner and the bank can and probably will start again, and ask the court to allow them to sell all his assets of which the K5 properties will be some, so we are back to square one. I believe this time and because of the judgement in K5’s favour, the court will say no to the Brits houses being sold and yes to those given to Yuksel Yilmaz in payment for the land. So that means another lengthy case, probably another appeal. It is now becoming ridiculous and we haven’t even touched on what might happen to Pauline’s villa, but since this will probably all drag on for another 5 years plus, what is the point in worrying about it.

    Do I think this case has been handled properly…no.
