Cyprus Law | Searching for JusticeWITHOUT PREJUDICE

Justice – a 7 letter word but such an important word.

Definition: The quality of being just; conformity to the principles of righteousness and rectitude in all things; strict performance of moral obligations; practical conformity to human or divine law; integrity in the dealings of men with each other; rectitude; equity; uprightness.

I personally do not doubt that all the people and groups now trying to obtain justice in north Cyprus will get justice but I suspect some will have to go as far as the ECHR to obtain it.

For those who are not aware, to be able to access the ECHR system, first all domestic remedies must be exhausted. This applies to everyone and not just residents of north Cyprus. The only problem with this is that by the time this is done, most litigants will be too old, too ill, too poor or dead. I am sure the concept of justice was never meant to be confined to the rich or the young, but events have demonstrated that this is, in the majority of instances in civil litigation, the fact and nowhere is this more evident than in north Cyprus. I am sure there will many who will object to this statement, citing other places where the situation is the same or similar. Well, my answer is, it is just as unfair there too, however I am interested in what the ‘powers that be’ in north Cyprus are going to do to help those caught up in this trap, simply because they trusted the north Cyprus government and its system to protect them when they purchased a home/investment there.

I have been reading about this:

Pilot-Judgment Procedure – European Court of Human Rights – www.echr.coe.int/Documents/Pilot_judgment_procedure_ENG.pdf

If you Google this there is much information about this scheme but my understanding is that the one group from north Cyprus who tried to use this route, found a road block and was not successful.

Whichever way you look at the situation here in north Cyprus, the very fact that a lot of purchasers are pensioners tells you they will not live to either see, or enjoy, their victory even if they win. Natural justice says they should be; that is not a guarantee.
