Kulaksiz 5 v Akfinans Bank – Case Date Brought Forward

I have just been informed that the K5 court date for the continuation of the main case hearing has been bought forward to the 8th, 9th, and 10th September.

It is expected that the rest of the defence evidence will be heard and then cross examination will take place, followed by the summing up of both the petitioner’s and defence’s advocates.

Whether the three new dates given will be sufficient for this process remains to be seen.  Of course further dates will be allocated if necessary.

I was not informed of a change in the Judge so I must assume Judge Usar is still the presiding Judge.

It is unusual since the summer recess does not normally end until mid-September. Perhaps someone has been reading NCFP and my dissatisfaction of the length of time all court cases take in the TRNC.

Meanwhile, back in the ROC where there is a mirror image situation with regard to stealth mortgages, the Foreclosure Bill meant to ease the process of repossessions of property that has been in serious arrears for a long period of time, stumbles from one obstacle to another. Figures in excess of 2 billion Euros in arrears on domestic mortgages are being quoted.

Sadly no measures appear to be in place to protect the victims of stealth mortgages in the ROC and amongst the Non Performing Loans are mortgages taken out by rogue developers using their victim’s property as security. Clearly the victims, as in the north, think this deserves to be addressed and, as in the north, no one is listening.
