Estate Agents Should Return Commission For Failed SalesWITHOUT PREJUDICE

I have been asked by Mr David John Barnett, a member of Stop the Blackmail in North Cyprus, to go public with his attempts to engage help from the government.

Mr Barnett has sent emails requesting the return of the commission paid to Unwins Estate Agents when purchasing
his property at Amaranta Valley, one of Robb(er)’s properties.

I personally was told in a face to face meeting with the head of the Estate Agents Association Mr Hasan Sungur that
a purchaser was entitled to the return of the commission paid to the Estate Agent if the purchase never completed. I think it is fairly safe to say, Mr Barnett will never have ownership of the property he paid for in his lifetime.  Therefore demanding the return of the commission, is in my opinion, a very reasonable demand.

This is how Mr Barnett has attempted to achieve this. These are copies of emails sent to Unwins Estate Agents, Mr Hasan Sungur and Gurkan and Gurkan which were ignored and prompted his sending copies of same to the Prime Minister of this new open government we all keep hearing about.

I forwarded the e mail as show below to Mr. Hasan Sungur, Head of the Estate Agents Association on the date shown on the e mail. I also sent copies to the parties mentioned under the text.
It is fairly obvious that I am being ignored as I have not received a reply from any of them.
Can I please ask you to help me in this matter?

I am approaching you in your capacity as Head of the Estate Agents Association.
As a purchaser of a property on Amaranta Valley development which was sold to me by Unwins Estate Agents, I wish to have the commission received by them returned to me.
The property I purchased was described a RED 42 on the Amaranta development.
This is in line with the Estate Agents Law of 2007/2008, a law I know you helped to draft.
I do not expect to ever be able to take title or possession of this unfinished, rapidly deteriorating
I have already sent this request to my Advocate at that time Akan Gurkan and to Unwins Estate
Agents, but I have not had the courtesy of a reply.
Your help will be greatly appreciated.

It is very sad that the TRNC is suffering because of the wrong doings of some and since it is over a decade that the Amaranta/Robb saga has blighted the property industry.
Were you aware that Akan Kursat the advocate acting for Akfinans Bank Limited was a co shareholder in Aga Development Limted?
Were you aware that the law firm Talat Kursat was mentioned in the court judgment SOCA v Gary Robb and the Judge felt they were implicated in the money laundering of Aga funds?

To recap then. David has received an acknowledgement of his communication to the Prime Minister and informed it would be passed to him, well over a month ago. Still no reply. So that would be a full house then David…you are being ignored by everyone. Nothing new there then.

We are hearing good things of the new President Mr Akinci, perhaps an email to him then David?

    Yes I can see the idle barstewards queuing up to give us back the money, they NEVER earned.

    Too many never completed their sale.

    Another…and I cannot call them professional set of people who value themselves FAR TOO HIGHLY.

    5 and 5% commission…for doing what? Aiding and abetting in a fraud.

    In general, a dodgy crowd. When I was selling, I lost count of the agents whom I had never employed who brought viewers to my place.

    One had told the viewers that if there was anyone home, we were holidaymakers. He told them we didn’t speak English, so not to speak to us!

    Goodness knows what that was about!

    And I could write a book about many of the Cypriot viewers that came round!
