Kulaksiz 5 v Akfinans Bank | Date of Verdict Released

At last the date the Kulaksiz 5 litigants have been waiting for.

On Thursday 4th December 2014, Judge Talat Usar will render his verdict on the main case of Kulaksiz 5 -v- Akfinans Bank Limited.

Basically Judge Usar will tell both sides whether it was lawful for Akfinans Bank Limited to have given landowner Yuksel Yilmaz a 83,000 TL mortgage using as security the property he had already sold to the K5 litigants, and whether the Auction of our property was lawful. In short he will find either for, or against the Kulaksiz 5. In my opinion, whatever the verdict, the losing side will Appeal the decision.

Many will remember the events of Sunday the 6th June 2010, the day the Kyrenia Tapu auctioned the homes of the K5 and the day the bank bought the property they held as security against the loan they gave to Yuksel Yilmaz with the then Director of Kulaksiz Construction Limited, Abdurrhman Guney allegedly acting as guarantor.

Despite the presence of the late founder/father of TRNC Mr Rauf Denktas, the auction went ahead, however the bank delayed their bid until he left.

Whatever the final outcome of the case is, we always enjoyed the support of the late former President.

    All TRNC advocates are optimistic……………if they told the truth who would put business their way? Here is just a few of the most common lies they tell their clients.
    “No there is not a memorandum on this property”
    “Yes you will get PTP on Pre 74 its just a formality”
    “Yes the developer is the land owner”
    “This is a legally binding contract”

    I personally would exchange the word optimistic for something more fitting like hoodwinking!

    I am with you Polly I can’t see it going in favour of the K5. TRNC law is interpretated differently depending on Advocate and Judge.It is written in such a way that this Judge will simply use his own interpretation and state that what has happened is legal. He might give a talk about it being unethical, immoral and call for a change in the law, but at the end of the day his “loyalties” will be elsewhere. This will go all the way to the ECHR and only then will there be a chance of justice.

    I too have had trouble logging in. Had to get in differently as page just would not download. Kept getting a message giving me the option of killing the page or waiting. It then just timed out when the wait option was (not using chrome) selected.

    I agree with you Sue, even if K5 miraculously won in TRNC, it would be unenforceable as Akfinans would refuse to vacate Pauline’s house or the house belonging to Eva McCluskey, both of which were illegally snatched.

    Maybe the others would have their properties on the basis of possession being 99% of the law. But I do not believe a win in TRNC is on the cards.

    ECHR is the only chance K5 have of any success and even then suing Turkey is a big gamble now that Erdogan is in power. Would he honour any judgement against
    Turkey?

    Even if the unbelievable happens and K5 win, do we really believe a bank that thinks it is okay to try to disgrace their victims with an ugly smear campaign, break into and take two of the villas, drive a vehicle at speed at a victim, issue Libel writs to silence the truth, enter a TV studio and proceed to attack people whilst a programme
    denouncing their loan methods is being aired, will even take any notice of a judgement
