Freedom of Speech in Cyprus | don’t forget that we are in the Middle East

Freedom of SpeechTo publish, or not to publish, that is the question?

As I made you all aware, ABC bank were most keen that my current address appear on the court papers in relation to the Kulaksiz 5 -v- ABC case. Now clearly from day one they must have been aware that I did not live at 5 Demokrasi Sokak, Karsiyaka as given when the case was started. Why, because members of the ABC Bank owners’ family occupy it. However, it suddenly became an issue and I was obliged to surrender my address to the court, something I did not want to do, out of fear.

On Thursday the 2nd February 2012, during my absence, a Bailiff visited my home. Clearly, I was not there, but my beloved was. The Bailiff did not speak much English and my beloved’s understanding of what he said was that he had come to collect the costs awarded against K5 in their case of the 26th August 2011. The costs that appear on the decision are in the sum of 2000 lira and yet it appeared that the Bailiff was asking for 2800 lira. It had been pointed out to me previously that the Judge had allowed that the bank could claim the costs from any one of us or all of us. Now you see where I am going with my address being suddenly important! Of course, in my opinion, it was always going to be me. I am the thorn in the flesh, the one they tried to exclude unsuccessfully from the case. To further complicate the issue, we the K5 have lodged an Appeal against this decision and therefore, rightly or wrongly, assumed that monies would not be payable until the Appeal had been heard and then only if we lost.

The plot thickens even further because, in amongst the words in Turkish on some of the other paperwork, my beloved spotted a word he did understand – internet. Poor love was now really confused. The Bailiff did not serve any papers, how could he, I was not there. He did however leave his name and telephone number which was used by a Turkish Cypriot friend who ascertained that yes, the purpose of the visit was correct and to serve a Writ on me about my writing on the internet.

K5 are in court again on Thursday 9th February 2012.
